These Terms of Service (the “Terms”) govern your access to and use of www.atelierfoudre.com (the “Site”) and your purchase of products from FOUDRE (together, the “Services”).
Please read these Terms carefully. By browsing the Site, creating an account or placing an order, you confirm that you accept these Terms and agree to be bound by them.
If you do not agree with these Terms, please do not use the Services.
Nothing in these Terms limits any mandatory consumer rights available to you under applicable law.

Email is our primary customer support channel. We aim to respond within 1–3 business days.

2. The Site and its platform
The Site is hosted on Shopify Inc., which provides the online e-commerce platform that allows us to offer and sell our products.
Your use of certain features of the Site may also be subject to Shopify’s applicable terms and policies.
3. Eligibility and accounts
By using the Services, you confirm that you are at least the age of majority in your place of residence and have the legal capacity to enter into a binding contract.
The Services are not intended for children.
If you create an account, you agree to provide accurate, current and complete information and to keep it updated.
You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.
Please contact info@atelierfoudre.com promptly if you believe your account has been accessed or used without authorisation.
We may suspend, restrict or close an account where we reasonably believe it is being used fraudulently, abusively or in breach of these Terms.
4. Product information, colour and measurement tolerance
We take reasonable care to describe and photograph our products accurately.
However:
Colour. Colours displayed on the Site may vary depending on your device, screen calibration, brightness and lighting conditions. The actual shade of a garment may therefore differ slightly from how it appears on your screen.
Reasonable screen-related colour variation does not necessarily constitute a defect.
Measurements. Garments may be produced in batches and certain pieces may include hand-finished elements. Reasonable variations in measurements may occur.
Any measurement tolerances specifically stated on a product page form part of the product description.
Materials and craftsmanship. Natural or handmade elements such as embroidery, embellishment, lace, beading, stitching or fabric texture may contain minor variations or irregularities that are characteristic of the manufacturing process and do not necessarily constitute defects.
Nothing in this Section affects your statutory rights where a product is faulty or materially different from its description.
5. Orders and formation of contract
Placing an order on the Site constitutes an offer to purchase the selected products.
After placing an order, you may receive an automated order confirmation. This confirms that we have received your order but does not necessarily mean that the order has been finally accepted.
A binding contract is formed when we accept the order and begin fulfilment or dispatch it, subject to applicable law.
We reserve the right to decline or cancel an order in the circumstances described in these Terms.
6. Prices, pricing errors and payment
Prices are displayed in the currency shown on the Site or at checkout.
Unless expressly stated otherwise, shipping costs, import duties, customs charges, clearance fees and similar destination-country charges are not included in the product price.
Shipping charges, where applicable, are displayed or calculated at checkout.
We may change prices from time to time, but a price change will not normally affect an order already accepted by us.
Despite our efforts, a product may occasionally be incorrectly priced or described.
If we identify an error before dispatch, we may contact you and offer the option to proceed at the correct price or cancel the affected product or order.
Where a pricing error is obvious and could reasonably have been recognised as an error, we may cancel the affected order and refund the amount paid.
Full payment is due at checkout using one of the payment methods made available through the Site.
If a payment is declined, reversed, cancelled or identified as potentially fraudulent, we may suspend or cancel the order.
7. Our right to refuse, limit or cancel orders
We may refuse, limit or cancel an order where reasonably necessary, including where:
- a product is unavailable or out of stock;
- we reasonably suspect fraud or unauthorised use of a payment method;
- quantities exceed reasonable personal-use limits;
- the order appears to have been placed for unauthorised resale or commercial distribution;
- billing or delivery information is materially inaccurate or incomplete;
- a promotional code or offer has been misused;
- we cannot deliver to the address supplied; or
- a material pricing or product-description error has occurred.
Where we cancel an order that has already been paid for, we will refund the applicable amount.
Nothing in this Section affects mandatory rights available to consumers under applicable law.
8. Shipping, delivery and passing of risk
Orders are processed Monday to Friday, excluding public holidays.
Most pieces are prepared for dispatch within 2–12 business days, depending on product availability, season and order volume.
Delivery estimates are not guarantees.
Full shipping details are set out in our Shipping Policy, which forms part of these Terms.
We are not responsible for delays caused solely by events outside our reasonable control, subject to applicable consumer law.
Where applicable law provides that risk remains with us until delivery, risk in the goods passes to you when you or a person nominated by you takes physical possession of them.
Title to the goods passes once payment has been received in full, subject to applicable law.
9. Customs, duties and import taxes
International orders may be subject to import duties, taxes, customs charges and clearance fees imposed by the destination country.
Unless expressly stated otherwise at checkout, these charges are not included in the product or shipping price and are the responsibility of the recipient.
FOUDRE does not control these charges and cannot predict their amount.
We cannot declare an artificially reduced customs value or falsely identify a commercial purchase as a gift.

10. Cancelling an order before dispatch
You may request cancellation by emailing info@atelierfoudre.com within 24 hours of placing your order, provided it has not already been dispatched.
Once an order has entered dispatch, cancellation may no longer be possible.
After dispatch, eligible products may instead be returned in accordance with our Returns & Refund Policy and any statutory withdrawal rights that apply to you.
11. Returns and refunds
Our Returns & Refund Policy forms part of these Terms.
In summary:
- eligible return requests should normally be initiated within 14 days of delivery;
- returns must be arranged with us before being sent;
- products should be returned unworn, unwashed, unaltered and with original tags and applicable packaging;
- approved refunds are normally processed within 10 business days after the returned product is received and approved;
- refunds are normally returned to the original payment method;
- return shipping for a change-of-mind return is generally the customer’s responsibility, subject to applicable consumer law;
- where a product is faulty, damaged in transit or incorrectly supplied, applicable return costs will be handled in accordance with our Returns & Refund Policy and applicable law.
Where consumers have mandatory statutory withdrawal or return rights, those rights take priority over any inconsistent provision in these Terms.
12. Faulty, damaged or incorrect products
Please inspect your order when it arrives.
If an item is damaged, faulty or materially different from what you ordered, contact info@atelierfoudre.com as soon as reasonably possible.
Providing your order number and clear photographs of the product, packaging and shipping label where relevant will help us investigate the issue.
Nothing in these Terms limits statutory rights relating to faulty, misdescribed or non-conforming goods.
13. Exchanges
We do not currently offer direct exchanges.
If you require another size or colour, you may return an eligible item according to our Returns & Refund Policy and place a new order.
This allows you to secure available stock without waiting for your original return to be completed.
14. Promotions, discount codes and gift cards
Promotional codes and offers are subject to the conditions stated with them.
Unless expressly stated otherwise, promotional codes:
- are non-transferable;
- have no cash value;
- cannot be combined with other offers; and
- may be limited to one use or one code per order.
We may withdraw, amend or cancel a promotion where permitted by law.
We may cancel an order or invalidate a promotional code where we reasonably believe the code has been obtained or used fraudulently or contrary to its stated conditions.
Gift cards are non-refundable and cannot be exchanged for cash except where required by law.
15. No unauthorised resale or commercial use
Unless we have given prior written permission, products purchased through the Site are intended for personal use.
You may not purchase products through the Site for unauthorised resale, wholesale distribution, commercial rental or other commercial redistribution.
You may not represent yourself as an authorised FOUDRE reseller, stockist, distributor or agent without our written permission.
We may refuse or cancel orders that we reasonably believe have been placed for these purposes.
16. Intellectual property
All content appearing on the Site, including the FOUDRE name and branding, product photography, videos, garment imagery, text, graphics, layout and other creative material, is owned by or licensed to FOUDRE or its respective rights holders and is protected by applicable intellectual property laws.
You may view the Site and make reasonable copies for your own personal, non-commercial use.
You may not, without prior written permission, reproduce, republish, distribute, sell, commercially exploit, adapt or use our Site content, imagery or product descriptions on marketplaces, websites, advertisements or social media accounts.
Nothing in these Terms transfers any intellectual property right to you.

17. Your content, reviews and photographs
If you voluntarily submit a review, comment, photograph, video or similar material to FOUDRE or publicly tag FOUDRE in content clearly intended for brand interaction, you confirm that you have the necessary rights to that content.
Where you expressly provide content to us for publication or marketing use, you grant us a non-exclusive, worldwide, royalty-free licence to reproduce, adapt, publish and display that material in connection with our business, subject to applicable privacy and consumer laws.
You may contact info@atelierfoudre.com if you wish to ask us to stop using content you directly supplied to us.
You must not submit material that infringes another person’s rights or is unlawful, misleading, threatening, abusive or defamatory.
18. Acceptable use
You agree not to:
- use the Services for an unlawful, fraudulent or harmful purpose;
- attempt to gain unauthorised access to the Site, an account, server or connected network;
- upload or distribute viruses, malware or harmful code;
- use automated scraping, crawling or similar systems to copy or systematically collect Site content, pricing or catalogue information without permission;
- harvest personal information about other users;
- place fraudulent orders or use another person’s payment method without authorisation;
- intentionally interfere with or overload the operation of the Services;
- infringe our intellectual property rights or the rights of third parties; or
- harass, threaten or abuse our staff.
We may restrict or terminate access to the Services for serious or repeated breaches of this Section.
19. Third-party links and services
The Site may contain links to third-party websites, applications or services that are not controlled by FOUDRE.
Such links are provided for convenience.
Unless expressly stated otherwise, we do not endorse and are not responsible for the content, availability, products, policies or privacy practices of third-party services.
Your interactions with third parties are governed by the terms applicable to those third parties.
20. Disclaimer of warranties
To the fullest extent permitted by applicable law, the Site and Services are provided on an “as is” and “as available” basis.
We do not guarantee that the Site will always be uninterrupted, error-free or available at all times.
We do not exclude any warranty, condition, guarantee or statutory right that cannot legally be excluded.
In particular, nothing in this Section affects mandatory consumer rights concerning the quality, conformity, description or fitness of products.
21. Limitation of liability
To the fullest extent permitted by applicable law, FOUDRE will not be liable for indirect or consequential business losses arising solely from use of the Site where such losses were not reasonably foreseeable.
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, nothing excludes liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence where applicable, or any mandatory consumer protection right that cannot lawfully be excluded.
For consumers, our liability remains subject to the mandatory protections available under applicable law.
22. Indemnification
Where legally enforceable, you may be responsible for losses or reasonable costs arising directly from your deliberate misuse of the Services, infringement of another person’s rights or material breach of these Terms.
This provision does not apply to the extent a loss results from our own breach, negligence or misconduct, and does not apply where prohibited by applicable consumer law.
23. Events outside our control
We are not responsible for a failure or delay caused by circumstances beyond our reasonable control, such as:
- severe weather or natural disasters;
- fire or flooding;
- epidemic or pandemic;
- war, terrorism or civil unrest;
- strikes or industrial disputes;
- major telecommunications or utility outages;
- cyber-attacks;
- carrier or supplier disruption;
- customs or border delays;
- import or export restrictions; or
- actions or restrictions imposed by public authorities.
Where such an event substantially delays an order, we will provide the remedies required by applicable law and may, where appropriate, arrange a revised delivery or cancel the affected order and issue the applicable refund.
24. Payment disputes and chargebacks
If you experience a problem with an order, please contact info@atelierfoudre.com first so that we have an opportunity to investigate and resolve it.
Nothing in these Terms restricts your legal right to report an unauthorised or fraudulent transaction to your bank, card issuer or payment provider.
Where a payment dispute is raised for an order that was validly delivered, previously refunded or otherwise resolved, we may provide relevant supporting evidence to the payment provider, including delivery records and correspondence.
25. Governing law and dispute resolution
These Terms are governed by the laws applicable to FOUDRE and to the relevant transaction, subject to mandatory consumer protection rules.
If you are a consumer, nothing in these Terms deprives you of mandatory rights available under the law of your country of habitual residence where those rights apply.
Where required by applicable law, you may bring proceedings in the courts having jurisdiction over your consumer claim.

26. Time limits for claims
Any contractual time limitation in these Terms applies only to the extent permitted by applicable law.
Nothing in these Terms shortens a mandatory limitation period or statutory period available to a consumer.
27. General
Entire agreement. These Terms, together with our Privacy Policy, Returns & Refund Policy, Shipping Policy and other policies expressly incorporated into them, form the agreement between you and us concerning use of the Services and purchases through the Site.
Severability. If any provision is held unlawful or unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue to apply.
No waiver. A failure or delay by us in exercising a right does not constitute a waiver of that right.
Assignment. Rights and obligations may be transferred where permitted by applicable law, including as part of a merger, acquisition, restructuring or transfer of the business.
Notices. We may contact you using the email address associated with your account or order or through notices on the Site.

Language. These Terms are written in English. Where translations are provided for convenience, the English version will govern to the extent permitted by applicable law.

We may update these Terms from time to time to reflect changes in our business, products, Services or legal and regulatory requirements.
The version applicable to an order is normally the version in effect when that order is placed.
When these Terms are updated, the revised version will be published on the Site and the “Last updated” date will be changed.

Our collection, processing and use of personal information is described in our Privacy Policy, which forms part of the framework governing your use of the Services.
